If we are to believe Wetzel's account of the events on that night, Miller pulls up with the loaded gun as requested, hands it to Miles, Miles hands it to Davis and says "there's one in the [chamber]". At that point, Davis gets out, walks to the car and starts firing, including the bullet that fatally wounds the young lady. The gentleman in the car returns fire, and a couple of bullets even strike Miller's vehicle. Where was Miles at this point? Seems to me he was just "there" at the scene, and got charged. Exactly like Miller, he handled the gun but didn't actually pull the trigger. Did he even get out of the car? Was he still sitting in the car with Miller? If so (or even if not), why is he more criminally culpable than Miller? Why was he charged with capital murder and not Miller? There is ZERO difference in their involvement other than Miles was involved in the events leading up to the killing, which really has nothing to do with the legal elements of the crime of capital murder.
