Defense attorney Mark Dutton told Lawrence County Circuit Court in Moulton, Alabama, that state laws banning sex between teachers and students aged under 19 were vague and ran contrary to the US Constitution.
Dutton said Boyles’ alleged victim was old enough to go to war, and that he was two years over the Alabama age of consent at the time of the spring 2017 encounters.
Many US states, including Alabama, make sex between adult authority figures and teens a criminal offense even if the victims are over the age of consent.
Boyles is accused of having oral sex and sexual intercourse with the boy on two occasions a week apart at her house, when she was 27 and he was 18.
