Next, the DOJ/ATF has issued three (3) releases tonight with links to new policy guidance on some of the DOJ/ATF regulatory responsibilities of these new orders....and they are as follows...
1. The first of three (3) ATF issued guidance links on new policy as a result of Obama's new Executive Orders to be formally announced tomorrow...
This one has to do with the new requirement on who must possess a federal firearms license in order to legally sell guns to the public....this sounds like a new LAW to me instead of policy guidance on existing LAW to a federal agency. Hoping this one gets tested in court eventually.

2. This is the 2nd link to new policy guidance to the ATF pursuant to Obama's new Executive Orders on gun control which will be formally announced tomorrow. This does sound like policy guidance on existing law to a federal agency (the ATF in this case) and is clearly not new law.
However, this new policy guidance makes it sound like people were able to gain ATF approval for NFA purchases without passing a background check and that is clearly not the case....comes suspiciously close, coming from the White House and the DOJ, like deliberately confusing propaganda meant for public consumption to me.
Factually, any individual taking possession of an NFA item transferred on a Form 4 must fill out a 4473 and pass a background check. That's always been the case. You should also know that an individual making an NFA item on a Form 1 must have filled out a 4473 for the receiver or firearm when originally purchased, and gone through a background check. The only way you would not have a background check is to manufacture the firearm from an 80% receiver or manufacture a suppressor from scratch parts. If the person doing this is ineligible to own a firearm in the first place, what makes you think they're going to bother with the NFA process?

Like the 2nd policy guidance I posted above, this is not new law but guidance to a federal agency (the ATF in this case) on the execution of the new executive orders.
It is patently ridiculous, however, that this guidance is so convoluted that it takes 248 pages to define and document the guidance. Just simply ridiculous. Our founding fathers would clearly be incensed and consider the existing 22,000+ federal, state, and local gun laws combined with policy guidance as complicated as this as clear and inarguable INFRINGEMENTS on the ability of free citizens of these United States' to keep and bear arms. Anyone who argues otherwise is not being genuine (honest) or is delusional...or just politically motivated to defeat the 2nd Amendment by fiat instead or repealing it...or both.
