Two Mobile doctors are facing federal charges for allegedly committing health care fraud and illegally distributing pain pills.
Dr. John Patrick Couch and Dr. Xiulu Ruan were indicted by a grand jury last month in the U.S. District Court in Mobile for conspiracy to distribute controlled substances outside the usual course of professional practice and not for a legitimate medical purpose, and conspiracy to commit healthcare fraud.
Couch and Ruan jointly own Physician's Pain Specialists of Alabama, according to the indictment. PPSA has two locations in Mobile at 2001 Springhill Ave., and 4682 Airport Blvd. Additionally, they own C&R Pharmacy, located adjacent to their practice on Airport Boulevard.
The doctors conspired to illegally distribute Oxycontin, Roxicodone, Opana, Dilaudid, morphine, fentanyl, and methadone beginning in January 2011, according to the indictment.
Around the state time, they also allegedly ordered expensive urine tests under the false pretense that they were necessary, the indictment states. The tests were billed to the patients' insurance companies because the insurers would pay a high reimbursement rate.
According to the indictment, the doctors also participated in a scheme where a service performed by someone other than a doctor was billed under the doctor's national provider identifier number. That way, the insurance companies would see that a doctor performed the service and reimburse them at a higher rate.
Federal investigators are looking to seize the forfeiture of "numerous bank accounts, exotic vehicles, and real property," if the defendants are convicted on either account, the indictment states.
These exotic vehicles include Ruan's Aston Martin DB9 Volante, Audi R8 Spyder, 2007 Bentley Continental, 1987 BMW M6, Ferrari F430 Convertible, Ferrari, 599 GTB, 1994 Lamborghini Diablo, 2008 Lamborghini, 2005 Mercedes SLR, 2011 Mercedes Model SLS AMG, 2013 Mercedes SLS AMG GT, Shelby Series 1, and Spyker C9 Laviolette, according to the indictment.
Authorities also want to seize Couch's 2008 Cadillac Escalade, 2010 Land Rover, 2013 Masarati, and 2015 Porsche 911, the indictment states.
Additionally, the FBI and DEA searched five locations including both PPSA clinics, C&R Pharmacy, a warehouse where Ruan stored his exotic cars, and Couch's house.
"We will remain vigilant in prosecuting doctors who place greed over their Hippocratic Oath to help their patients and are otherwise willing to defraud and undermine the health care programs of the nation," said U.S. Attorney Kenyen R. Brown in a press release.
