Important No Bid General Contract Legislation (long)

Just when you think you've heard it all the State of Alabama legislature surprises you and as normally not in a positive way.

There is legislation trying to be passed now that would eliminate competitive bidding on public works projects. Essentially this will go a long way to eliminate the small and medium sized General Contractors and will eventually eliminate a lot of subcontractors as well. The work will go to a select few contractors who will then decide who the subcontractors will be.

There's no way anyone in their right minds could think this is a good idea other than those very select few that it'll benefit.

Everyone has a dog in this fight Public works construction (schools, state buildings, municipal buildings, etc) already cost the tax payers enough. Anyone in the industry knows how tough it is to get a project in a budget these days. Passage of this bill will make it many times more difficult to build the schools and facilities that are needed.

HB275 By Rep. Mark Tuggle (Construction Manager/General Contractor) has been
introduced in the House and is in State Government Committee on Wednesday.



I am adamantly opposed to this legislation.





This bill allows no-bid contracts on public works projects and will
definitely cost tax payers more money on every public works job. Any time you
don't bid a job it always costs more money.

The drafters of the bill have eliminated pricing from the selection process
all together (see page 14 lines 15 - 27) because they know it will cost more.
Pricing of the project is not even a factor.



This bill will hurt every small to medium size contractor and subcontractor
in Alabama and will cost thousands of jobs across the State. This bill allows
the CM/GC to openly select their friends to be subcontractors on the job which
cuts out everyone except their friends.



Local General Contractors and Subcontractors have a proven track record of
building quality structures across this state and nation. This bill suggests
that we are not capable of doing an excellent job on a local projects and that
is wrong.



Please support local small and medium size businesses in opposition to this
legislation.
